By accessing or using Evaly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Evaly is an online assessment platform that allows users to create, distribute, and analyze tests and quizzes. The Service includes both free and paid features.
3. User Accounts
3.1 Registration
To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Upload content that infringes on intellectual property rights
- Distribute malware or harmful code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service
- Use the Service to harass, abuse, or harm others
- Create tests designed to discriminate unlawfully
- Scrape or collect data from the Service without permission
5. User Content
5.1 Ownership
You retain ownership of content you create on the Service, including questions, tests, and other materials. By using the Service, you grant us a license to host, display, and process your content as necessary to provide the Service.
5.2 Responsibility
You are solely responsible for your content and ensuring it does not violate any laws or third-party rights.
6. Intellectual Property
The Service and its original content (excluding user content), features, and functionality are owned by Evaly and are protected by copyright, trademark, and other intellectual property laws.
7. Payment Terms
7.1 Pricing
Some features require a paid subscription. Prices are subject to change with notice. Current pricing is available on our pricing page.
7.2 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method on file.
7.3 Refunds
Refunds are handled on a case-by-case basis. Contact us within 14 days of purchase for refund requests.
8. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service will immediately cease.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVALY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
11. Indemnification
You agree to indemnify and hold harmless Evaly and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Evaly operates, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If unresolved, disputes shall be submitted to binding arbitration.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
